Board Findings and Resolution of Adoption:

By-Right Approval on Previously Identified Sites

To ensure consistency between the Zoning Code and Housing Element Update, Section 18.114.140 of the Zoning Code was amended to allow by-right approval for future housing development within the following eight sites identified for this Housing Element cycle, consistent with Government Code 65583.2. These eight sites were also identified in the two previous housing cycles.

The following sites were identified in the 4th and 5th Cycle Housing Elements in addition to the current Housing Element Cycle:

• APN 034-140-010 
• APN 064-062-025 
• APN 064-083-036 
• APN 064-180-012 
• APN 064-180-013 
• APN 070-111-017 
• APN 060-130-031 
• APN 065-091-007 

Additional sites used in this Housing Cycle are noted in the Housing Element. 

Government Code Section 65583.2 (By-Right Development Requirements):  

A nonvacant site that has been included in two or more consecutive planning periods that was not approved to develop a portion of the locality’s housing needs…is subject to a program in the housing element requiring rezoning by the applicable deadline for rezoning to allow residential use by right for housing developments in which at least 20 percent of the units are affordable to lower income households.  

Previous Drafts

HCD Submittal #5 

In response to the California Department of Housing and Community Development’s (HCD) feedback, the County prepared a fifth resubmittal of the Housing Element in August 2024. This version includes updates only to Appendix A (Public Review Summary) and Chapter 2 (Housing Plan) to address remaining comments from HCD. 

All other sections remain unchanged from Resubmittal 4. The final version has been adopted by the Board of Supervisors and submitted to HCD for certification.

Land Use Element and Zoning Code Update – Public Review Period June 18-July 18, 2025

The Madera County General Plan Land Use Element and Zoning Code have been updated to ensure consistency with the Housing Element. Changes include updates to residential development standards, updated analysis of the existing infrastructure in Disadvantaged Unincorporated Communities (as required under SB 244), and land use and zoning map updates that reflect the Housing Element’s site inventory. The public review period has ended; however, we encourage you to review the documents to familiarize yourself with any land use and/or zoning updates near your community.
